Yalla Deals is a registered platform and trademark owned and operated by JBR Labs FZ LLC. JBR Labs is registered in the Creative City in the Emirate of Fujairah, and is operating from the following addresses:

JBR Labs FZ LLC is the owner of Yalla Deals which provides the services to you according to our Terms of Use, (hereinafter referred to as “Yalla Deals”, “we” or “us” in this privacy policy). 

 

2. Information Collected

We collect several types of information from and about users of our Site, which we have grouped together follows:

Identity Data includes first name, last name, username or similar identifier, date of birth and gender. 

Google and Facebook Data:  With your permission, we collect data from your Google or Facebook account which includes your first name, last name, Facebook ID, and email address. If you register using Facebook and grant us permission via their in-app privacy feature, we may collect data such as your gender, age or email ID according to such permissions that you grant. 

Contact Data includes email address and telephone numbers.

Financial Data: If you purchase our paid services, we collect your credit card details. Card payments are handled by our partner PayTabs- a leading payment gateway that adheres to industry standards for payment processing, including compliance with The Payment Card Industry Data Security Standard (PCI DSS). Transaction Data includes details about payments to and from you and other details of services you have purchased from us.

Technical and Location Data: We collect device information identified with your Yalla Deals account in the form of unique identifier such as your operating system, network name, internet protocol (IP) address, login data (such as your registration date, date of last password change, date of last successful login), browser type and version, time zone setting and location, operating system and platform and other technology on the devices you use to access this website and our apps. Depending on the permissions granted by you, once you post on our platform, an automatic process collects various information in order to determine your location. This includes your IP address, Global Positioning System (GPS), Wi-Fi access points, and cell phone towers. Collecting location data enables you to view user items and post items within your vicinity as well. We also collect information about your activity on our Platform which includes the sites from which you accessed our Platform, date and time stamp of each visit, searches you have performed, listings or advertisement banners you clicked, your interaction with such advertisements or listings, duration of your visit and the order in which you visit the content on our Platform.

Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.  

Usage Data includes information about how you use our website, products and services. 

Marketing and Communication Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

Click Stream Data: We collect various statistical information with regards to your online activity on our Platform. Such activities include the searches you have conducted, the listings or ad banners you have clicked along with your interactions with them, websites which have directed you to our Platform, the date and time stamp of each visit, the duration of your visit, and the order in which you visit the content on our Platform. 

Cookies and Similar Technologies: Cookies are files with a small amount of data and may include a unique identifier such as your user sessions, date and time of your visit, your browsing history, your preferences, and your username.  We may use cookies to collect information in order to report website traffic, create aggregated statistical data, and improve our services. You can set your browser to block all or some cookies. Please note that in the event you disable or block cookies, certain parts of our Services/Platform may be deemed inaccessible or non-functional. We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, political opinions, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

You also may provide information to be published or displayed on the Site or transmitted to other users of the Site or third parties (collectively, “User Content”). Your User Content is posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of   other users of the Site with whom you may choose to share your User Content. In this case, we may have to cancel a service you have with us but we will notify you if this is the case at the time.

4. How and Why We Use your Personal Information

We will only use your personal information when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

1- To access our platform and receive Services: You can be identified as a user (through your first name and last name, mobile number, and e-mail address) once you log in using your phone number or email address. We use such logs is to deliver our Services to you in accordance with our Terms and Conditions. We may also use your registered e-mail address and mobile number to send your Short Message Service (SMS) messages, emails, and push notifications to your phone in order to make suggestions and recommendations to you about our Services that are relevant to you. 

2- Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. Our legitimate interests including keeping our records updated, and to monitor how you use our Services. Our activities include registering you as a new customer, preventing fraud and spam, managing payments, fees and charges, collecting and recovering money owed to us, managing our relationship with you, completing surveys by you, administering and protecting our business and Services and Platform (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data), and using analytics. Data such as your contact details, identity, profile, usage statistics, and other technical data are associated with such activities as they are necessary for our legitimate interests.  

3- Where we need to comply with a legal or regulatory obligation. This includes court orders and legal matters such as subpoenas and search warrants. Without limiting the foregoing, we have the right to cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Platform. If requested, we may share statistical and usage data with government entities for certain circumstances such as regulation, monitoring and incidents investigation. You waive and hold harmless Yalla Deals and its affiliates, licensees, and service providers from any claims resulting from any action taken by Yalla Deals or any of the foregoing parties during, or taken as a consequence of, investigations by either Yalla Deals or law enforcement authorities.

4- For improving our services on the Platform: This includes collecting analytics and various metrics such as determining how much time you spent on our Platform, and generally how you use our Platform. We do this to understand user behavior, improve our services, and understand your needs and interests. Based on your clicks, we also make suggestions and recommendations to you about services that may be of interest to you. 

5- Where we use your location data for following purposes: in order to properly run our services such as displaying ad listings which are close to your area to improve your purchase experience. We also endeavor to improve our services to you by personalizing such services with location data, and collecting anonymous, aggregated statistical information about your characteristics and behavior on our Platform.  We also evaluate and monitor your interaction with the third-party ad banners placed on our Platform.

Change of purpose 

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. 

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so. Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which services and offers may be relevant for you (we call this marketing).  You will receive marketing communications from us if you have requested information from us or purchased goods or services from us or if you provided us with your details when you entered a competition or registered for a promotion and, in each case, you have not opted out of receiving that marketing.

Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

We may occasionally make changes to this privacy policy (without notice to you) in order to keep it up to date with legal requirements, and the manner in which we operate our business. Your continued use of our Services and Platform -after we make any changes- means that you accept such changes. You are expected to check this page from time to time to take notice of any changes we made as they are binding on you. Therefore, please check the privacy policy page regularly for updates on our Services and Platform. Any changes are effective immediately upon posting on the Site.

7. Disclosures of Your Personal Data

We may disclose personal information that we collect, or you provide as described in this Privacy Policy:

- To our subsidiaries and corporate affiliates: We may share your data with other Yalla Deals affiliates and subsidiaries which are located within as well as outside European Economic Area (“EEA”) and the United Arab Emirates ("UAE"). This enables us to provide business operation services such as product enhancements, customer support, and fraud detection systems. If the GDPR applies to your personal data, then any sharing of your personal data within the Yalla Deals or its subsidiaries or affiliates which are situated outside the EEA will always be subject to safeguards as described in section __, or to a data transfer agreement which clearly defines the obligations of the parties and ensures appropriate technical and organizational measures to protect your data.

- To contractors, service providers, and other third-party service providers we use to support our business, and who are bound by contractual obligations to keep personal information confidential and thereby use such information only for the purposes for which we disclose to them. Examples of third-party service providers that help us deliver certain aspect of our Services include cloud storage facilities such as Amazon Web Services and Cloudflare. Service providers may be located inside or outside of the EEA and UAE.

- Your privacy is important to us. This is why we conduct privacy and security checks on third party providers to ensure that the privacy and security of your personal data are being handles correctly, and that such providers treat your personal data lawfully. We do not permit third party service providers to use your personal data for their own purposes. Instead, we only allow them to handle your personal data for specified purposes and in accordance with our instructions.

- In the event your personal information is being held by Yalla Deals during a business divestiture, reorganization, restructuring, dissolution, or other sale or transfer of some or all of Yalla Deals’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, the buyer or other successor will acquire your transferred personal information as part of the company assets which are transferred. we may seek to acquire other businesses or merge with them. If such change happens to our business, then the new owner(s) may use your personal data in the same way as set out in this privacy statement.

- To fulfil the purpose for which you provide it. 

- Advertising and analytics providers: In order to improve our Services, we will sometimes share your anonymous information with analytics providers such as Metabase that help us analyze how people are using our Platform/Service. We share your information with the min non identifiable form for monitoring and reporting the effectiveness of the campaign delivery to our business partners and for internal business analysis. - For any other purpose disclosed by us when you provide the information.

- With your consent.

- Law enforcement authorities, regulators and others: We may disclose your personal data to law enforcement authorities, regulators, governmental or public bodies and other relevant third parties to comply with any legal or regulatory requirements. 

- Publicly available information: When you post an item for sale using our Services, you may choose to make certain personal information visible to other Yalla Deals users. This may include your first name, last name, your email address, your location and your contact number. Kindly note that any personal information you disclose to other users may be shared by them with other parties, so please exercise caution with this regard.

You may have specific legal rights with regards to your personal data. This is contingent upon the country you reside in, or how we interact with you. We care about your privacy, and you are 100% in control of your personal information. Therefore, to the best of our ability we can provide you with choices with regards to your personal information that we currently process. In fact, we have created mechanisms to provide you with the following control over your information:

• Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. Right to request for the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

To file a complaint at any time with your local supervisory responsible for you as outlined in section 13. However, before you make a complaint to the data protection authority, we would appreciate the chance to deal with your concerns in the first instance. No fee usually required: You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

Time limit to respond: We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.

 

9. Communication and Marketing

We will communicate with you by email, SMS or in app notification in connection with our Services/Platform to confirm your registration, to inform you in case your ad listing has become live/expired and for other transactional messages in relation to our Services. As it is crucial for us to provide you such transactional messages you may not be able to opt-out of such messages. 

You may receive marketing communications from us if you:

- Asked us to provide you with such information;

- use our Platform or Services;

- filled out our forms with your details in the event of entering a competition; or

- registered for a promotion.

However, you can request to opt out or unsubscribe from our marketing communication at any time by clicking on the “unsubscribe” link at the bottom of our email, or “opt out” in the SMS message sent to you. Alternatively, or you can contact us on [email protected]

  

10. International Transfers

You agree that we may transfer your personal data to third parties inside and outside of the UAE. To the extent that the GDPR applies to our relationship with you, then whenever we transfer your personal data out of the EEA or UAE, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

Where we transfer your personal data to countries that have not been deemed to provide an adequate level of protection for personal data by the European Commission we will ensure that adequate safeguards are put in place, such as specific contract clauses that have been approved by the European Commission for use with third parties, which give personal data the same protection it has in the European Union. Where appropriate we may need to rely upon other derogation under the GDPR that allow for transfers out of the EEA to countries that are not deemed to provide adequate levels of protection or were we do not have adequate safeguards. 11. Data Retention and Location of Storage

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. The data we collect about you may be stored and processed inside as well as outside the EEA and UAE in secure Amazon servers in order to provide the best possible user experience. For example – for fast website or mobile application build up.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

12. Security Measures to Protect Your Personal Information

We have set appropriate, industry-standard security measures in place to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data based on our instructions, and they are subject to confidentiality agreements. 

All the data you provide to us is stored on secure servers and cloud infrastructure providers, and we have implemented technical and organizational measures that are suitable and necessary to protect your personal data. Such security measures include hosting your data on secure cloud infrastructure providers, using firewalls, passwords, and Cloudflare.  By default, our cloud infrastructure providers are private and can be accessed only by users that we explicitly grant access to. As an added protection, Cloudflare protects and secures our website, application, and APIs against denial-of-service attacks, customer data compromise, and abusive bots. 

We use strong encryption methods to protect your data such as HTTPS, SSE, SSL, and TLS, which means that your data Is encrypted -both at rest and in transit. Our cloud infrastructure providers support the HTTPS protocol, which encrypts your data in transit to and from them. In addition, our cloud infrastructure providers offer server-side encryption (SSE), so this means your data will also be encrypted at rest. 

We also have measures in place to deal with any suspected personal data breach. In the event a breach takes place, we will notify you along with any applicable regulator of any such breach- subject to legal requirements.
